In my previous post, I discussed the four elements that are required to prove medical malpractice: duty, breach, injury, and damages. However, even if these elements are established, the plaintiff may still face some challenges and obstacles in pursuing their claim. One of these challenges is the requirement of an affidavit of merit.
An affidavit of merit is a document that must be filed along with the complaint in some states, such as Illinois. The affidavit of merit must state that the plaintiff’s attorney has consulted with a qualified health care professional and has determined that there is cause for filing the lawsuit. The affidavit of merit must also identify the health care professional and provide a brief summary of his or her qualifications and opinions.
The purpose of this requirement is to prevent frivolous or baseless lawsuits from clogging the courts and wasting the time and resources of the defendants and the judiciary. It also serves to protect the reputation and integrity of the medical profession by screening out claims that have no merit or evidence.
However, obtaining an affidavit of merit is not always easy or straightforward. The plaintiff’s attorney must find a health care professional who is willing and able to review the case and provide an opinion that supports the claim. The health care professional must also have relevant expertise and credentials in the same field or specialty as the defendant. For example, if the defendant is a radiologist, the health care professional who provides the affidavit of merit must also be a radiologist or have sufficient knowledge and experience in radiology.
